I recall one day, in about 2003, when I was still a Chairman of Magistrates, and our bench was trying to jail a young man who had been armed with a knife.
We got the usual nonsense from his solicitor and were told that this was carried because 'he was in fear of attack and was only carrying it for protection'.
Anyone could state this rubbish. If accepted, it means that literally nobody can be jailed for carrying a blade.
The Clerk of The Court, our Legal Representative, prevented us from imposing a custodial sentence. He stated that our sentence would promptly be overturned, that same morning, by a judge in chambers.
Our INjustice system is a disgrace!
