Everybody is fearful of being sued - even when the fault lies with the alleged victim.
Consider this situation.Your home and garden is regularly invaded so you place some barbed wire on top of the wooden fence where the evil-doers gain entry. One such receives a major gash on the arm which turns septic and suddenly you are looking at a court case - with 'no win, no fee' lawyers poised to act for the scrote and you either having to fund expensive solicitors - or settle out of court. It could wreck you financially for all time!
I have long argued for 'A Law of Common Sense' to be placed on the statute books to which any and all legal decisions may be referred.
The idea behind this is to ensure that such miscarriages of justice - whether technically within the law or not - may be overruled in order to prevent the law from 'being an ass'.
The spurious cases of this type would disappear rapidly as would the equally disgraceful misuse of industrial tribunals.
